2023 New Jersey Site Remediation Conference

 

NJ LSRPA’s power-packed New Jersey Site Remediation Conference (NJSRC) is scheduled for June 1-2, 2023, at the Hyatt Regency in New Brunswick!

The NJSRC is the ONLY Conference dedicated to site remediation in New Jersey. Just like past years, the 2023 Conference promises to deliver relevant courses for continuing education credits along with opportunities to network with peers and other industry professionals. Response Action Outcomes (RAOs) Issuance and Post-RAO Compliance (Thursday, June 1 from 10:00am - 12:00pm)

Description: Just when you think you are DONE! The issuance of a Response Action Outcome (RAO) by an LSRP is intended to be the final remediation document providing assurance the remediation of a contaminated site or area of concern (AOC) is protective of public health, safety and the environment. But what comes with the issuance are many post-regulatory, technical and legal reviews and compliance responsibilities of which site remediation practitioners should be knowledgeable. This 2-hour course will provide an overview of the regulatory requirements for issuing RAOs along with the important post-compliance aspects of an RAO. Topics covered include: NJDEP inspection process, post-RAO RAP conditions and compliance, the role of an LSRP post-RAO, and potential site re-openers and impacts.

Use of Spreadsheet Models for Site Characterization and Decision Support (Thursday, June 1 from 10:30am - 12:00pm)

Description: Site characterization and remediation benefit from tools that provide quantitative constraints of the site and contaminant behavior and enable the investigator to develop a more realistic Site Conceptual Model. These tools also enable the environmental practitioners directing remediation at a site to quickly and reliably assess a site's hydrogeologic and geochemical behavior and decide whether further analysis is warranted or evaluation should be considered completed and proceed with the next phase of work. This course will focus on three tools to illustrate application in three different areas: Biochlor - for assessing reductive dechlorination, REMChlor - for assessing matrix back diffusion and Quick Domenico -for transport and dispersion. The course will present each model's governing equations and assumptions and provide examples of how each model is implemented. In addition, a discussion of how to organize and select data for use with these tools.

LSRP Ethics (Thursday, June 1 from 1:00pm - 4:00pm)

Description: Ethics again? Yes, again! This ever-evolving 3-hour LSRP Ethics course will provide the continued review and reinforcement of professionalism and ethics to LSRPs and environmental practitioners in performing their functions to protect human health and the environment. Instructors will explore professionalism and ethics from an LSRP perspective, the common conflicts and pitfalls, the Licensing Board rules versus the Code of Conduct, and recent enforcement actions and decisions. ISRA Beyond Basics (Thursday, June 1 from 1:15pm - 3:15pm)

Description: The Industrial Site Recovery Act (ISRA) arguably continues to be one of the most impactful hazardous waste cleanup laws in New Jersey. Enacted almost 40 years ago, the law and implementing regulations continue to drive the identification and remediation of contaminated sites. LSRPs, attorneys and environmental professionals will benefit from this course in understanding the continued application of the law, nuances, and special and difficult situations arising during remediation  While providing an overview ISRA process and procedures, as well as practical compliance tips the course will also explore more challenging aspects of ISRA, including areas of evolving application (leaseholds, historic fill, multi transactions and owners, multiple LSRPs, etc...).

Successful Remediation - Pitfalls to Avoid and Remediation Part 2 (Thursday, June 1 from 1:15pm - 3:15pm)

Description: Following up on "Successful Remediation...Part 1," which was well received in 2021, this course continues the focus on remediation in bedrock and the pitfalls to avoid. Consultants and remediation practitioners encounter many challenges when investigating and remediating contamination in bedrock. At times, bedrock is often considered too complex or too costly to remediation. Attendees will acquire an understanding of remedial design characterization techniques, geophysical methods, and remedial technologies to overcome challenges with remediation in bedrock. The course will also include lessons learned to attain remedial objectives and valuable case studies. Part 1 is not a prerequisite for Part 2 participation.

Presumptive and Alternative Remedies Technical Guidance (Thursday, June 1 from 3:30pm - 4:30pm)

Description: This course will review the NJDEP Presumptive and Alternative Remedies Technical Guidance and the associated technical requirements. The various requirements will be explored for implementing a presumptive remedy as well as the types of sites where a presumptive remedy is prohibited. In addition, a review will be done of the components and requirements for the submittal and approval of alternative remedies. Lastly, common issues with presumptive and alternative remedies submitted and reasons for rejection.

Utilizing Forensics, Lab Methods, and Regulatory Guidelines for PFAS and 1,4-Dioxane (Thursday, June 1 from 3:30pm - 5:30pm)

Description: The course is designed to provide an overview of the emerging contaminants landscape as it relates to analytical chemistry strategies, emphasizing testing, forensics and readiness for the often unforeseen forensics problems in environmental projects. In addition, the presentation will also discuss uses for the compound 1,4-Dioxane in manufacturing and a brief history of regulations; a review of current and future EPA methods applicable for the detection and quantification of 1,4-Dioxane; and which methods are most appropriate for meeting the regulatory standards. Lastly, the course will review the NJDEP developments in establishing formal groundwater quality standards for PFAS in site remediation activities, landfills, and regulated discharges to groundwater.

Presentation 1: Potential Health Risks Associated with Exposures to Trichloroethylene

This presentation will discuss the potential health risks associated with exposures to trichloroethylene (TCE) in the indoor air fact sheet available at: www.nj.gov/health/ceohs/documents/tce_factsheet.pdf. This fact sheet provides general information on TCE and describes potential health impacts on a developing fetus in the first trimester of pregnancy.

Presentation 2: Common Remedial Action Permit Application Deficiencies

This presentation will cover common Soil and Groundwater RAP Application deficiencies. The presentation will provide examples of typical errors found in RAP applications and how to address these errors properly.

Presentation 3: Online Underground Storage Tank (UST) Service

Speaker: Stuart Friedman, Section Chief, NJ Department of Environmental Protection, Bureau of Case Assignment and Initial Notice
This presentation will offer instructions on how to use the new UST Facility Certification Questionnaire. The Department is transitioning to this online service from the requirement to submit information in hard copy.

What Practitioners Need to Know about the Dirty Dirt Amendment to A-901 (Friday, June 2 from 9:00am - 10:30am)

Description: In response to the inappropriate use of not-very-clean soil and recycled material as fill, the New Jersey legislature passed the “Dirty Dirt” law, amending the existing A-901 statue to regulate “soil and fill recyclable material.” The “Dirty Dirt” amendment now requires registration by business concerns engaged in soil and fill recycling and broadens the definition of a “broker.” NJDEP policy statements have allowed for exemptions for LSRPs under specific circumstances. This course will review how this law impacts LSRPs and their firms, provide more information on the A- 901 licensing procedure, and provide information that will help you evaluate your firm, vendors or sub-consultants, or clients should pursue A-901 licensure.

PFAS - A Practical Guide to Navigating through the Regulatory Process (Friday, June 2 from 9:00am - 11:00am)

Description: New Jersey continues to be a regulatory leader in proposing and promulgating standards for PFAS.  In the absence of a robust PFAS toolbox, how to navigate a site to closure is tricky. This program will review the regulatory, technical and practical challenges responsible parties, environmental practitioners and LSRPs must navigate when evaluating and investigating per- and polyfluoroalkyl substances at their sites.

Sustainable Resilient Remediation for a Changing Climate: Practical Applications (Friday, June 2 from 9:00am - 11:00am)

Description: The concepts of sustainable resilient remediation (SRR) and green and sustainable remediation (GSR) continue to grow and evolve. Companies, government agencies and society are advancing environmental, social and governance (ESG) and climate-resilience goals and policies that strongly emphasize SRR practices. Environmental practitioners are challenged daily to evaluate and select sustainable and resilient remedies that are also acceptable in cost, constructability, and practicality. This course will provide an overview of SRR concepts, a review of the regulatory and non-regulatory drivers of SRR, an identification of Sustainable Best Management Practices (SBMPs) to implement at SRR projects, and a discussion of SRR implementation strategies in the site remediation context, and information and resources including checklists, tools and contacts.

Innovative Methods to Characterize and Remediate Fractured Bedrock (Friday, June 2 from 1:30pm - 3:30pm)

Description: Typically many bedrock sites are under-characterized or overlooked for injection operations due to the insufficient data available to model the transport and storative regime in the subsurface. This presentation will review the tools to successfully and succinctly characterize a fractured bedrock site, using both conventional and modern techniques and design for high-energy injections. Real case studies will be used of high-density, vertical borehole Remedial Design Characterization (RDC)- discrete groundwater and rock matrix sampling- that augments existing Conceptual Site Models (CSMs) and refines, or completely refreshes, the remediation design.

Remedial Action Permits - Approval Strategies and Role of Independent Professional Judgement (Friday, June 2 from 1:30pm - 3:30pm)

Description: Application for and the approval of a Remedial Action Permit (RAP) continues to be highly controversial and the process is difficult to navigate. Why? Have you asked yourself "What did I miss?" "Is there a better strategy?" "Can I use my independent professional judgment?" This course will provide an overview of the recent NJDEP RAP Guidance Document updates, including RAP Application and Biennial Certification Forms, successful strategies for environmental practitioners to obtain approvals and most importantly, how to best apply independent professional judgement. In addition, information on how to anticipate and proactively address compliance issues during the Biennial Certification submission process.
